Terms and Conditions

Payment conditions and cancellations for 1/2 day and day trips as well as dive safaris or diving courses:

• Bookings for day trips and/or diving courses will only be confirmed after receipt of payment.li>
• The National Marine Park fee is payable on board or in advance (Phi Phi / Similan-Inseln).
• This fee is subject to change without notice and is controlled by the Thai authorities.
• Certified divers must show their certification card before diving. Failure to do so may result in the trip being canceled or you being denied diving. No refund possible.
• Cancellations must be made in writing via email.

Cancellations must:

• 7 days or more prior to the date of the 1/2 day, day trip, liveaboard and/or diving course to be entitled to a FULL refund, less bank/credit card fees and/or any exchange rate losses. National park fees not included.
• If you have between 6 days and 48 hours before the 1/2 day, day trip, liveaboard and/or diving course, you will receive a 70% refund.
• If you have between 48 and 24 hours before the 1/2 day, day trip, liveaboard and/or diving course, you will receive a 30% refund.
• Less than 24 hours prior to 1/2 day, day trip, liveaboard and/or diving course, no refund is possible.
• Once a course has started and the participant does not show up, no refund is possible.

According to a decree from the Thai authorities, entrance fees to national parks in Thailand are non-refundable under any circumstances and will be deducted from the refund.

Conditions for diving trips (1/2 day and day trips as well as diving safaris by boat):
In the event of force majeure, the dive boat company reserves the right to change, postpone and/or cancel diving arrangements if the diving destination is remote or inaccessible. Local customs as well as fire, flood, earthquake, storm, hurricane or other natural disasters, war, political unrest and other circumstances exist hostilities, whether war is declared, or other technical or mechanical difficulties render the arrangements unsafe, dangerous and/or become impracticable. If adverse weather conditions prevail that make it dangerous or inadvisable for customers or the boat to land and enter port, the Captain reserves the right to postpone departure until more favorable conditions prevail. This may require an adjustment to the itinerary, which may result in the cancellation of landing at a particular port and/or a change in the order of island visits.

Risk and liability declaration for diving and diving trips:
This is a statement informing you of the risks and dangers that arise when you travel and participate in snorkeling or scuba diving as a certified diver or as a student under the control and supervision of a certified instructor. This statement applies to recreational diving/snorkeling trips and diving/snorkeling trips conducted as part of a course. This statement also sets out the circumstances under which you participate in the diving/snorkeling trip at your own risk.

Your signature on the declaration is required as proof that you have received and read the declaration. It is important that you read the contents of the declaration before signing it. If you do not understand anything in this statement, please discuss it with your instructor/diving professional. If you are a minor, this form must also be signed by a parent.

Warning:
Diving and recreational diving involve risks that could result in serious injury or death. Diving with compressed air involves certain risks. Decompression sickness, embolism, or other hyperbaric injuries may occur that require treatment in a hyperbaric chamber. Open water diving/snorkeling excursions may be conducted at a location remote in time or space from such a pressure chamber.

SIGNATURE, DIGITAL SIGNATURE:
Your signature and all complete information requested on this form is required to participate in diving and related activities with ADM Venture Co.Ltd. / Scuba Quest Phuket Dive Center. You must be in good health, have any known health problems, and inform your divemaster or instructor of any use of medication or intoxicating beverages before starting any diving/snorkeling activity. Your divemaster or diving instructor will give you a diving/snorkeling briefing in advance on all safety issues in and out of the water.

You will also be informed about the technical parts of your equipment. Mishandling your equipment can be dangerous and result in serious injury. I acknowledge the above information and agree that ADM Venture Co.Ltd./Scuba Quest Phuket Dive Center and its employees are not responsible for any incidents that occur during the duration of the diving/snorkeling training and/or during any water activities . By signing this agreement, I agree to accept full liability for any incidents, injuries or death resulting from foreseeable or unforeseen circumstances. I also agree to be 100% liable for any loss or damage to the rental equipment.

I also declare that I am of legal age and have the legal capacity to sign this release of liability or that I have obtained the written consent of my parent or legal guardian. By signing and submitting this form, I declare that I fully assume all associated risks. I waive any claims against the publisher or recipient of this form that may arise from the use or processing of the information contained herein.

Data privacy:
Scuba Quest Dive Center respects your privacy. When processing personal data, we attach great importance to protecting your privacy and the security of your data. In this data protection declaration we inform you about what data we process, why we need it and how you can object to the processing of your data. We only collect, process and store personal data to the extent permitted by law or if you have given your consent, for example when registering for an event or service.

What personal data do we collect:
The personal information we collect is limited to information about our relationship with you. This includes contact information such as name, telephone number, address or email address. How do we collect personal data? Generally, we collect personal information in the following cases: Register with Scuba Quest for diving, snorkeling or a boat trip.

How long do we keep your personal data:
We retain your data for as long as is necessary for our business relationship with you or as long as we have a legitimate interest in continuing to store the information. In all other cases, we delete your personal data unless further storage is required by law.
